Charitable Sales Promotion Information

Hawaii law requires all charitable sales promotion written consents to contain the following provisions:

Describe the goods/services being offered to the public by the business CCV

Example: food and beverage, car rentals, special t-shirt

Benefit to the charitable organization Describe how the name of the charitable organization will be used to promote the event (including any representation to be made to the public about the amount or percent per unit of goods or services purchased or used that will benefit the charitable organization). Example:

20% of net sales of food and beverages purchased will be donated to charity, excluding alcohol.
$0.09 of each specially marked T-shirt sold will be donated to charity.

Date the charitable organization will be paid. Payment must be made within 90 days after the end of the charitable sales promotion and, for charitable sales promotions lasting more than one year, within 90 days after the anniversary date of the charitable sales promotion and within 90 days after the final completion of the charitable sales promotion.

How will the charitable organization be paid (cash, check, etc.)?

Date by which a copy of the final accounting shall be provided to the charitable organization. An accounting on a per unit basis must be provided to the charitable organization within 90 days after the end of the charitable sales promotion and, for charitable sales promotions lasting more than one year, within 90 days after the anniversary date of the charitable sales promotion and within 90 days after the final completion of the charitable sales promotion.
